In April 2009, Femern A/S was appointed by the Minister of Transport to undertake preparatory work, investigations and the planning of a fixed link across the Fehmarnbelt.

This was in the context of the "Act on the Planning of a Fixed Link across the Fehmarnbelt with Associated Landworks", which was approved by a large majority in the Danish parliament.

On 28 April 2015, the Danish parliament adopted the bill for the Construction Act for the Fixed Link across the Fehmarnbelt and the Danish landworks. The Act means that the State-owned companies, Femern A/S and A/S Femern Landanlæg, are respectively authorised to build and operate a fixed link across the Fehmarnbelt, and the associated landworks in Denmark.

The Construction Act represents the final environmental approval of the project in Denmark.

Femern A/S is part of Sund & Bælt Holding A/S, which is 100 per cent owned by the Danish Ministry of Transport. Sund & Bælt Holding A/S is also responsible for the fixed link across Storebælt.

The company has its head office in Copenhagen. It also has offices in Burg (Fehmarn) and Rødbyhavn. The company had 90 employees as at 1 November 2016.
